In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions. 

 

Class Action Waiver 

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Aerospace Testing Lab agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

To the maximum extent permitted by law, this agreement is governed by the laws of the State of Connecticut and you hereby consent to the exclusive jurisdiction and venue of courts in Connecticut in all disputes arising out of or relating to the use of the Site. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Aerospace Testing Lab as a result of this agreement or use of the Site. Aerospace Testing Lab's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Aerospace Testing Lab's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Aerospace Testing Lab with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Aerospace Testing Lab., Inc. values the privacy of our employees, customers, vendors, and individuals with whom we conduct business, and it is our policy to protect and safeguard the confidential nature of personal, non-public information that we obtain in the ordinary course of business. This information includes, for example, Social Security numbers, drivers’ license numbers, state identification numbers, account numbers, credit or debit numbers, passport numbers, alien registration numbers, and health insurance identification numbers. Personal information does not include information that is lawfully and publicly available. 



Aerospace Testing Lab., Inc. has implemented reasonable technical, physical, and procedural safeguards to help protect sensitive personal information from unlawful use and unauthorized disclosure. In addition, all Aerospace Testing Lab., Inc. employees are required to follow established policies regarding the safeguarding of confidential information. Social Security Number Privacy Policy and Operating Procedure


It is the policy of the company to protect the confidentiality of Social Security numbers obtained and used in the course of business from its employees and applicants. All executives, managers and employees are expected to rigorously adhere to this policy. Any employee violating the provisions of this policy and its operating procedures will be disciplined in accordance with company rules.


Operating Procedures


1. Collection of Numbers: Social Security numbers will be collected from applicants and employees as required in order to meet federal and/or state reporting requirements. These purposes include:


• To conduct pre-employment background checks.


• To verify eligibility for employment.


• To withhold federal and state taxes.


• To comply with state new-hire reporting.


• To facilitate enrollment in company benefits plans.


Note: Social Security numbers may also be collected from clients, creditors, suppliers or independent contractors where no tax identification or employer identification number is accessible. Social Security numbers so obtained will be subject to the same provisions of the privacy policy as those for applicants and employees.


2. Use of Numbers: Except for verification and reporting uses for the above-referenced reasons, no Social Security number or portion of a Social Security number will be used in the conduct of the company’s business and


• No Social Security number or portion of a Social Security number will be permitted to be used for the following purposes: identification badges, parking permits, time cards, employee rosters, employee identification records, computer passwords, company account records, licenses, agreements or contracts.


• No Social Security number or portion of a Social Security number will be used in open computer transmissions, company distributions or through the company intranet except where such transmission of information is by secure connection or is encrypted. As examples, reporting of payroll withholding taxes and benefit plan participation require such data; thus, such transmissions of data will be handled through secured computer transmission only.


3. Storage of and Access to Numbers:


• Storage: All documents containing Social Security numbers shall be stored in locked secured areas. All computer applications containing Social Security numbers shall be maintained on secured, authorized-access computer stations only.


• Access: Only persons who have a legitimate business reason will have access to Social Security numbers; such access will be granted through department heads responsible for functions with reporting or transporting of such data responsibilities. Department heads and employees granted such access must take all necessary precautions to ensure the integrity of records that include such numbers when the records are not being used.


4. Destruction of Numbers: Records that include Social Security numbers will be maintained in accordance with federal and state laws. When such documents are released for destruction, the records will be destroyed by shredding.


5. State Laws: Where this company policy and operating procedures may conflict with a state law in any state in which the company operates, the state law shall supersede this policy.

I. OVERVIEW & SCOPE 

 

Aerospace Testing Lab, Inc. of 32 South Satellite Rd, South Windsor, Connecticut 06074, has established an Anti-Discrimination and Equal Employment Opportunity Policy ("EEO"). This EEO policy applies to all aspects of the relationship between Aerospace Testing Lab, Inc. and its employees, including, but not limited to, employment, recruitment, advertisements for employment, hiring and firing, compensation, assignment, classification of employees, termination, upgrading, promotions, transfer, training, working conditions, wages and salary administration, and employee benefits and application of policies. These policies apply to independent contractors, temporary employees, all personnel working on the premises, and any other persons or firms doing business for or with Aerospace Testing Lab, Inc.. Disciplinary action will be taken against any employee or agent in breach of this policy. 

 

II. POLICIES 

 

1. DISCRIMINATION. Aerospace Testing Lab, Inc. shall not tolerate, under any circumstances, without exception, any form of discrimination based on race, creed, religion, color, age, disability, pregnancy, marital status, parental status, veteran status, military status, domestic violence victim status, national origin, political affiliation, sex, predisposing genetic characteristics, sexual orientation, gender identity and gender expression, and any other status protected by the law. 2. HARASSMENT. Aerospace Testing Lab, Inc. is committed to providing a work environment that is free from harassment. Harassment can occur between members of the opposite sex or the same sex. All employees, including supervisors, other management personnel, and independent contractors, are required to abide by this policy. 3. SEXUAL HARASSMENT. Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature constitute harassment when (1) submission to such conduct is made either explicitly or implicitly a term or condition of employment; (2) submission to or rejection of such conduct by an individual is used as a basis for employment decisions, promotion, transfer, selection for training, performance evaluations, benefits, or other terms and conditions of employment; or (3) such conduct has the purpose or effect of creating an intimidating, hostile, or offensive work environment or substantially interferes with an employee's work performance . Aerospace Testing Lab, Inc. prohibits inappropriate conduct that is sexual in nature at work, on Company business, or at Company-sponsored events including the following: comments, jokes, degrading language, sexually suggestive objects, books, or any form of media electronic or in print form. Sexual harassment is prohibited whether it is between members of the opposite sex or members of the same sex. 

 

4. REPORTING DISCRIMINATION & HARASSMENT. If an employee feels that he or she has been harassed as described in this policy, they should immediately report the matter to management or Human Resources Department, Kathie Lee, klee@aerospacetestinglab.com through any verbal or written means. If that contact is not available, or if the employee is not comfortable informing this contact, the employee should immediately inform any other manager or supervisor. Once the matter has been reported it will be promptly investigated and any corrective action will be taken when deemed appropriate. All complaints or unlawful harassment under this policy or otherwise will be handled in as confidential a manner as possible. Timely reporting is encouraged to prevent the re-occurrence of, or otherwise address, the behavior that violates this policy or law. Delays in reporting a complaint can limit the type of effectiveness of a response by Aerospace Testing Lab, Inc.. The procedure for reporting incidents of discriminatory or harassing behavior is not intended to prevent the right of any employee to seek a remedy under available state or federal law by immediately reporting the matter to the appropriate state or federal agency. 

 

5. RETALIATION. Retaliation against any person associated with Aerospace Testing Lab, Inc. who reports instances of harassment - whether he or she is directly or indirectly involved - is in violation of Aerospace Testing Lab, Inc.'s policies. All reported incidents are assumed to be made in good faith. Any allegations that are proven false will be treated as a serious matter. 

 

6. DISCIPLINARY MEASURES FOR HARASSMENT. Any employee engaging in behavior that violates this policy will be subject to disciplinary action, including the possible termination of employment, whether or not an actual law has been violated. 

 

7. REMEDIES. Remedies for any instances of verified employment discrimination, whether caused intentionally or by actions that have a discriminatory effect, may include back pay, hiring, promotion, reinstatement, front pay, reasonable accommodation, or other actions deemed appropriate by Aerospace Testing Lab, Inc.. Remedies can also include payment of attorney's fees, expert witness fees, court costs and other applicable legal fees. 

 

8. POLICY IMPLEMENTATION. Implementation of this Policy will be effective as of May 12, 2020.
